Terms of Service

These Terms of Service (“Terms”) govern your access to and use of datavinci.services and the consulting services provided by DataVinci, Pvt Ltd (“DataVinci”). By engaging our services or using our website, you agree to be bound by these Terms.

1. Scope of Services

DataVinci provides digital growth solutions, including Business Model Analysis, Conversion Optimized UX design, Performance Marketing Testing, and Data Engineering. The specific scope, deliverables, and timelines of our engagements will be detailed in separate Statements of Work (SOW) or service agreements.

2. Client Obligations & Platform Access

To execute our services effectively, you agree to grant DataVinci the necessary access, permissions, and OAuth tokens for your digital properties, advertising accounts, and analytics platforms. You maintain ownership of all your proprietary data.

3. Right to Use Logo & Case Studies

Unless explicitly restricted by a separate Non-Disclosure Agreement (NDA), you grant DataVinci the right to use your organization’s name, logo, and aggregated performance metrics (e.g., percentage lifts in Conversion Rate or AOV) in our marketing materials, intro decks, website, and case studies.

4. Services Provided “AS-IS” & Disclaimer of Warranties

DataVinci employs rigorous quantitative and qualitative analysis to execute A/B testing and marketing strategies. However, market dynamics fluctuate. THE SERVICES AND IMPLEMENTATIONS ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. DataVinci disclaims any guarantees regarding specific financial outcomes, uninterrupted software performance, or the functionality of third-party platforms (such as Google Analytics, Shopify, or advertising networks).

5. Limitation of Liability

IN NO EVENT SHALL DATAVINCI, PVT. LTD., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, OR TORT.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
